These Terms & Conditions ("Terms") govern your access to and use of Social Drafters (the "Service"), operated by Peyayra Dossa (doing business as "Social Drafters", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

Social Drafters provides AI-assisted social media content planning, drafting, and scheduling tools for creators, marketers, and agencies. Features include content generation, planners, brand kits, and related tools.

2. Eligibility & Account

• You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
• If you sign up on behalf of an organization, you represent that you have authority to bind that organization.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate information and keep it up to date.

3. Acceptable Use

You agree not to misuse the Service. You will not:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Send spam, scrape data, or interfere with the security or performance of the Service.
• Upload malware or attempt to gain unauthorized access to other accounts or systems.
• Infringe the intellectual property, privacy, or other rights of any third party.
• Generate content that is illegal, defamatory, hateful, sexually exploitative, or designed to deceive.

4. AI-Generated Content

• You are responsible for the prompts you submit and the outputs you publish.
• AI outputs may be inaccurate or incomplete. You must review outputs before relying on or publishing them.
• You must have the rights to any content (images, text, brand assets) you upload to the Service.
• We may filter, refuse, or remove outputs that violate these Terms, and may suspend accounts for repeated abuse.
• Rights-holders may submit takedown requests to support@socialdrafters.com.

5. Intellectual Property

The Service, including its software, branding, and documentation, is owned by Peyayra Dossa and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscription plan. You may not reverse engineer, resell, redistribute, or circumvent any technical limitations of the Service.

You retain ownership of the content you upload. You grant us a limited license to host, process, and display that content solely as needed to provide the Service to you.

6. Payments & Subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

Subscriptions renew automatically at the end of each billing period unless canceled. Credits and add-ons are consumed according to the pricing shown at checkout. See our Refund Policy for refund details.

7. Service Availability

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free performance. Features may change, and we may schedule maintenance or release updates.

8. Suspension & Termination

We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your account at any time. On termination, your access ends and we may delete your data after a reasonable period.

9. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service shall not exceed the amounts you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is prohibited by law.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from your content, your use of the Service in violation of law, or your breach of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law principles. Disputes shall be brought exclusively in the state or federal courts located in Travis County, Texas.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
